Exchange Rates For Credit Card Payments Are Subject To Change
Indonesian banks can only accept Credit Card payments converted to Indonesia Rupiah. Our reservations office will convert the payments due for bookings into Rupiah at the US Dollar exchange rate of the day of invoicing and fax or email you a Credit Card Authorization Form, with the invoice, for your required signature. Due to the often wildly fluctuating Rupiah exchange rate the Credit Card Authorization Form is valid for only three days unless the rupiah is relatively stable at the time of invoicing. If the form has not been returned to us by fax within three days we reserve the right to send an adjusted form reflecting the change of the Rupiah to US Dollar conversion rate.
Deposit
A deposit of 50% is required to confirm your reservation. On payment of this deposit you will be deemed to have accepted these Terms and Conditions. We reserve the right to cancel a reservation without notice if the deposit is not received within seven days of the booking being made.
Balance
The balance of the billing (including transfer charges) is to be received by us at least 3 months prior to the first day of your stay with us. We will send an invoice and notice for the balance payment, with a Credit Card Authorization form if required. As our accommodation is limited, if we do not receive the balance by the due date, we may assume that you have cancelled your proposed stay with us.
Cancellations
Nihiwatu bookings are typically made six months to a year in advance. We rarely receive booking requests eight weeks or less prior to planed arrivals. Therefore for us we have to treat cancellations and no shows as a loss that cannot be recovered.
Cancellations must be made and received by Nihiwatu IN WRITING either by email or fax. Booking cancelled or reduced in number are charged as indicated below:
- Cancellations received more than 140 days prior to arrival incur a cancellation Fee equal to one day of accommodation.
- 90 – 139 days notice the Cancellation Fee is the forfeiture of 25% of the deposit paid
- 60 - 89 days notice the Cancellation Fee is the forfeiture of 50% of the deposit paid
- 40 - 59 days notice incurs a 75% Cancellation Fee for every night cancelled
- Less than 39 days notice a 100% Cancellation Fee for every night cancelled
- No refund will be given for No Shows or days not used resulting from Premature Departure.
- In cases of late arrival due to flight delays we will be happy to extend the stay provided there is space available, however we cannot be held accountable for such flight delays or cancellations.
- We strongly advise that you always purchase a reliable travel insurance policy, please note our recommendations regarding appropriate insurance protection.
Last Minute Bookings
In the event of a last minute booking made in Bali, payment method is to be prearranged with our Reservations manager. Full payment must be made at our Bali office before travel to Nihiwatu.
Change Of Arrival Dates Or Days Not Used
We will accommodate requests for a change of a confirmed arrival date provided we have space available for the new dates requested. In such cases there will be no cancellation fee applied. The new confirmed dates will be subject to the Cancellation terms shown above. No refund or credit will be given in whole or in part for days not used resulting from premature departure.
Insurance
We strongly recommend that you take out a comprehensive travel insurance policy at the time of booking. Please ensure that you and all those accompanying you are covered for the full time of your visit against illness, injury, medical evacuation, death, loss of baggage and personal items during travel and at Nihiwatu, flight and accommodation cancellation and other travel contingencies.
Responsibility
Please be advised that we are not responsible for any loss of or damage to personal equipment and property during your stay with us, or during your participation in any of our activities. Please also be aware that for your safety you are to follow any directions that may be given to you while you are staying with us or participating in any of our activities. We will not accept responsibility for any injuries that occur during your stay with us or when participating in our activities. Guests participating in scuba diving and horse riding activities are required to sign an indemnity release form. We will not accept responsibility for any delay, additional expense or inconvenience which may be caused directly or indirectly by events outside our control such as late arrival of International flights, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of government, or the failure of any machinery or equipment.
For surfers: If you are booking to surf at Nihiwatu please make close note of the following. We want to provide you with an unforgettable crowd free surfing experience and to do so we limit the number of surfers at Nihiwatu to nine only. There may be times, due to an extended booking, that an additional surfer is booked for a few days but generally we are very much comited to our nine surfer quota. For groups booking the whole resort there is no limit on the number of surfers, that is left up to the group to decide.
In the past two years too many guests have booked in as one surfer when in fact there were more. This has caused us considerable problems and of course complaints. To solve this problem we now allow one surfer in a bungalow and two surfers in a villa. Any additional surfers will be charged $100 each per night. We therefore need to know exactly how many of you will be surfing, and we need to know at the time of paying the deposit for your booking, your cooperation and understanding is very much appreciated. Adjustments will be made for additional surfers according to your response and added to your final billing.
Please note that only the registered surfers will be allowed to surf during your stay. If you do not respond and let us know how many of you will be surfing we will automatically book you as only one surfer for this booking and we reserve the right to deny additional surfers the opportunity to surf.
If you are planning to learn to surf, or a beginner surfer renting surfboards we need to know. You will be required to take a surf lesson before surfing on your own and your instructor will advise you of alternate surf breaks that are appropriate for your level of surfing abilities.
Governing Law
These Terms and Conditions are covered in all respects by the Law of Indonesia and any legal action arising under the contract shall be litigated only in the appropriate Court having jurisdiction in that country.
